Reasons Why Your Workers’ Compensation Claim Could Be Denied

Do you meet workers’ comp eligibility requirements?

Colorado workers compensation attorney

Do you believe your denial was reached in error?

Do you want to take it in front of an administrative law judge?

Common reasons for a denial of workers' comp benefits include (but are not limited to) the following:

  • Injury was not reported in time: State laws determine how soon you must report an injury to your supervisor, typically within a few days (in Colorado, employers must be notified in writing within four days or you could be subject to a penalty.)
  • Claim was not filed in time: State laws also determine deadlines for filing an initial claim. You have up to 2 years from the date of your injury. However, the longer you wait to report your accident, the harder it is to prove your case.
  • Employer disputes claim: Your employer may claim the accident happened outside of work, was the result of horseplay, or some other disqualifying reason.

Eligibility for Worker’s Compensation After Exposure to COVID-19 On-the-Job

Were you exposed to COVID-19 on the job and later tested positive?

Was personal protective equipment missing in your workplace?

Are you having trouble paying your bills because of your illness?
Colorado workers compensation attorney

According to the Department of Labor and Employment for Colorado, “regulation is imperatively necessary for the preservation of public health, safety, or welfare as ensuring operation of the workers’ compensation system is imperative to preserve the health of the citizens of Colorado.”

As reported cases of COVID-19 increase, it places a significant strain upon medical resources. Emergency rules are being promoted to increase access to telehealth services in order to assure injured workers maintain access to reasonable and necessary medical care while complying with physical distancing guidelines and mandates. COVID-19-related actions to promote physical distancing have disrupted workers’ ability to receive in-person care for their job-related injuries and illnesses. Continuity of care is essential to monitor the progress of recovery. Treatment delays impede recovery and may increase claims costs.

  • Your employer's settlement offer doesn't cover all your lost wages or medical bills.
  • Your medical issues prevent you from returning to your prior job, or from performing any work at all.

How does the worker’s compensation benefit process begin?

    Colorado workers compensation attorney
  1. Report the injury to your supervisor or employer immediately in writing;
  2. Request to see a doctor and get a list of which doctors you’re allowed to see; and
  3. Request and complete an employer’s first report of injury and or workers compensation claim form.
Until you report the injury and the claim form is returned to your employer, they're only under a limited obligation to provide benefits. A common mistake people make is waiting to report the injury until it becomes unbearable and they can no longer work.

Can I Change My Doctor?

Colorado workers compensation attorneyYou have a right to request a change of physician in the state of Colorado. In most cases, your employer will give you a list of physicians to choose from. If you suffered an on-the-job injury, your employer must give this list to you immediately upon notice of the injury. If you didn’t receive this form, you may be able to pick your own doctor.  If the form is given, the injured worker can switch to another doctor on the list within the first 90 days. Proving Heart Attacks as a Job-Related Illness Can Be Challenging

According to the 2012 Workers' Compensation Act, “a heart attack that occurs while a worker is performing his or her job is not automatically considered a work-related injury. Instead, the victim must prove that the heart attack occurred because he or she was subjected to unusual levels of exertion in the course of his or her job.”
