What Kind of Workers’ Compensation Do You Qualify For?

 Workers’ compensation benefits may include:

• Medical care – All the medical care and prescription costs that you need should be covered by your employer through their workers’ compensation insurance

• Medical mileage including to therapy and pharmacy visits

• Temporary Partial Disability – If you can still work, but with limitations

• Temporary Total Disability – If you can’t work at all after the accident

• Permanent Total Disability - If you’re never able to earn any wages in the future.

• Permanent Partial Disability – If you still have limitations or disabilities after you reach maximum medical improvement from treatment.

The income you receive depends on your average weekly wage in the time leading up to the accident and whether you can work with restrictions following your injury. If you disagree with the insurer’s determination of your benefits, you have the right to contest the decision. An attorney for workers’ compensation may represent you.

Common Ski Resort Workplace Accidents You Should Be Aware of

Colorado Workers Compensation Attorney

Skiing facilities” have the third-highest non-fatal injury rate among all industries in the U.S., according to the Occupational Safety and Health Administration (OSHA). Even though most resorts make worker safety a priority, accidents are inevitable. For example, ice can build up in areas around the slopes, or a guest may not practice safe skiing behavior.

Some of the most common injuries among ski resort employees include:

1. Falls from slipping on ice or snow

2. Collisions with other skiers or boarders

3. Lifting-related injuries from transporting injured skiers or snowboarders

4. Strains and sprains

5. Getting caught or falling when assisting someone out of a lift

6. Lacerations, cuts, and bruises

Glenwood Springs workers compensation attorneys

Within 20 days of receiving the first report of injury (or, the date it should have been received), the insurance company must issue a decision about whether or not to provide benefits coverage to you.

If the insurance company finds you eligible for benefits, it will begin paying for your medical expenses and payments for time lost from work. You will receive a letter from the insurance company titled "Admission of Liability."

Reasons Why Your Workers’ Compensation Claim Could Be Denied

Do you meet workers’ comp eligibility requirements?

Colorado workers compensation attorney

Do you believe your denial was reached in error?

Do you want to take it in front of an administrative law judge?

Common reasons for a denial of workers' comp benefits include (but are not limited to) the following:

  • Injury was not reported in time: State laws determine how soon you must report an injury to your supervisor, typically within a few days (in Colorado, employers must be notified in writing within four days or you could be subject to a penalty.)
  • Claim was not filed in time: State laws also determine deadlines for filing an initial claim. You have up to 2 years from the date of your injury. However, the longer you wait to report your accident, the harder it is to prove your case.
  • Employer disputes claim: Your employer may claim the accident happened outside of work, was the result of horseplay, or some other disqualifying reason.
