Reasons Why Your Workers’ Compensation Claim Could Be Denied

Do you meet workers’ comp eligibility requirements?

Do you believe your denial was reached in error?

Do you want to take it in front of an administrative law judge?

Common reasons for a denial of workers' comp benefits include (but are not limited to) the following:

  • Injury was not reported in time: State laws determine how soon you must report an injury to your supervisor, typically within a few days (in Colorado, employers must be notified in writing within four days or you could be subject to a penalty.)
  • Claim was not filed in time: State laws also determine deadlines for filing an initial claim. You have up to 2 years from the date of your injury. However, the longer you wait to report your accident, the harder it is to prove your case.
  • Employer disputes claim: Your employer may claim the accident happened outside of work, was the result of horseplay, or some other disqualifying reason.

Always use proper lifting techniques when you’re moving something heavy. Stretching before a strenuous activity can also help warm up your joints. If you do a lot of bending or twisting, you should practice stretching and wear proper shoes to reduce back pain. You may also consider taking breaks and moving around throughout the day to prevent your muscles from tightening up.

What to Do if Your Workers Compensation Claim is Denied

Colorado workers compensation attorneys
Are you struggling to make ends meet because of a workplace injury?

Do you think you may be eligible for workers' compensation benefits?

If your workers’ compensation was wrongfully denied, we can investigate further. A denied claim is not the end. Here’s what you can do to improve your chances of receiving financial compensation:

Get an Attorney: Your odds of receiving a positive outcome increase substantially when an attorney represents you in court. When you represent yourself, you’ll likely be outmaneuvered by the insurance company.

Provide Compelling Evidence: Providing substantial evidence supports your claim.  An administrative law judge could review new evidence to support an appeal. Footage of the incident, witness testimony, and records are all potentially good evidence.

Petition to Review: If you’re still unhappy with the outcome, you can petition to review the denial.
