When is the best time to hire an attorney?

You should hire an attorney when your case gets too complicated to handle on your own. For example, in any of these situations, you should contact a lawyer:
  • Your employer denies your claim or you fail to receive your benefits promptly.
  • Your employer's settlement offer doesn't cover all your lost wages or medical bills.
  • Your medical issues prevent you from returning to your prior job, or from performing any work at all.
  • You receive Social Security disability benefits.
  • Your boss retaliates against you for filing a workers' comp claim.
  • You have a potential third-party claim.

How does the worker’s compensation benefit process begin?

    Colorado workers compensation attorney
  1. Report the injury to your supervisor or employer immediately in writing;
  2. Request to see a doctor and get a list of which doctors you’re allowed to see; and
  3. Request and complete an employer’s first report of injury and or workers compensation claim form.
Until you report the injury and the claim form is returned to your employer, they're only under a limited obligation to provide benefits. A common mistake people make is waiting to report the injury until it becomes unbearable and they can no longer work.

Can I Change My Doctor?

Colorado workers compensation attorneyYou have a right to request a change of physician in the state of Colorado. In most cases, your employer will give you a list of physicians to choose from. If you suffered an on-the-job injury, your employer must give this list to you immediately upon notice of the injury. If you didn’t receive this form, you may be able to pick your own doctor.  If the form is given, the injured worker can switch to another doctor on the list within the first 90 days. Employer Forcing You to Return to Work Before Recovery is Complete?

Colorado workers comp attorneyIs your employer manipulating the spirit of inclusive "return to work" policies?

Is your employer forcing you to perform different tasks that utilize different skills - before your recovery is complete? Employees feel powerless to argue with their employers because they fear losing their jobs. This shouldn’t happen.

Colorado's Office of Risk Management and the Federal Equal Employment Opportunity Commission both receive and process allegations and complaints when companies have violated fair employment practices. If you or a loved one has been forced back to work too soon following an on-the-job injury, consider speaking with an experienced workers' compensation attorney in Glenwood Springs.
