Injured on the Job? Know Your rights!

Are you using every available resource to help with your recovery?

Are you aware of what the Colorado workers compensation law does to help injured workers?

An injured worker in the state of Colorado is entitled to many benefits. Imagine not having to struggle to pay your bills! You’d be able to spend more time with your family every day, instead of worrying about writing checks.

According to the Department of Labor & Employment, injured workers can receive the following types of benefits, including:

Medical benefits - “Worker’s compensation insurance pays for all reasonable and necessary medical expenses, if the care is received from an authorized treating physician.” Also, medicine, travel expenses for medical appointments, and other supplies can be covered by the insurance company.

Temporary disability benefits – You’re eligible for workers compensation benefits in Glenwood Springs and the Western Slope if you’ve missed more than three shifts or three days due to a work-related injury or illness. “Payment for the first three days missed is only made if the employee is off work more than two weeks.”

Temporary total disability – If you cannot return to work again, then you qualify for total disability. “The rate for TTD is calculated at sixty-six and two-thirds percent of the average weekly wage (AWW) up to the maximum allowed.”

Temporary partial disability – You qualify for these benefits when you return to work with modified duties with reduced wages and or reduced hours. “This is calculated at two-thirds of the difference between the AWW at the time of the injury and the part-time earnings.”

Permanent impairment benefits – If you lose mobility, have a disfigurement, or impairment from your injury or illness, benefits are paid every two weeks until the award is paid out as compensation for the disability.

Reopening a claim – You can only re-open a claim if your condition worsened. However, if you waive the “right to re-open the claim, the settlement can be re-opened only if fraud or mutual mistake of material fact happens.”
